Refiling for sex registration termination after the petition has been denied once
Under the pre-June 2008 version of NRS 179D.490, a person who has been denied cannot apply again for another 5 years. This is what the previous version said:
"4. If the court does not terminate the duty of the sex offender to register after a petition is heard pursuant to subsections 2 and 3, the sex offender may file another petition after each succeeding interval of 5 consecutive years if the sex offender is not convicted of an offense that poses a threat to the safety or well-being of others."
However, the post-June 2008 version (A.B. 579) of the statute (effective July 1, 2008) deleted that language completely. Thus, under the current version of 179D.490, there is no restriction on when a person can re-apply.
The problem is last fall, a district judge in ACLU v. Masto placed a permanent injunction on the bill (A.B. 579).
To complicate things even more, a state court judge placed a preliminary injunction on A.B. 579 sometime last summer.
